When collecting your vehicle at the airport it is vital that you supply us with the correct flight details. We use the provided flight details to check on delays; this way we can assure you that your vehicle will not be given to another client and we will meet you at the airport. Should you not be sure that the flight number you provided us with is correct then please check it and respond to this email with the correct flight number. In any case, should you have any changes to make to your booking please don't hesitate in advising us by responding to this email. All bookings must include obligatorily a correct flight number. Please check all details before sending the form as any incorrect information will automatically make the booking void. The same applies for delivery in the train station in Malaga or the cruise terminal of the port of Malaga.
Collection at Malaga Airport:
After collecting your luggage, please DO NOT GO DOWNSTAIRS to the car rental desks, but go out the sliding doors looking for the arrivals hall exit. Once outside the terminal:
- Continue straight ahead until you reach the road.
- Cross the zebra crossing.
- Continue to the train station, our pick-up point is just behind the building, where one of our representatives properly uniformed will be waiting for you holding a MalagaCar.com sign. Map: malagacar.com/link/pickup
A Malagacar.com shuttle bus will be with you shortly to take you on the short, two minute, drive to our offices.
Please remember that we are "Malagacar.com", as there are some other companies that call themselves Malagacar, but this is not true.
It is very easy to recognize us as our logo can be found on the contracts, uniforms, car keys, mini bus, etc.
Collection at Malaga Train Station (Maria Zambrano):
After leaving the platform go to the main exit of the station. Just outside the exit you will find one of our representatives with a Malagacar.com sign who will identify himself as an employee of the company.
Our office is located in the airport area. The employee WILL ASSIGN YOU AN IDENTIFYING NUMBER TO ENSURE YOUR TURN IN THE MINIBUS AND OUR OFFICE once you have arrived with our free minibus service.
An orange minibus of Malagacar.com will pick you up to take you in a short trip of 7 kilometres (around 15 minutes) to our offices.
You can easily recognize us by our logo, which you will find in contracts, uniforms, vehicle keys, etc.
The car will be returned in our office located at Malaga Airport area. Our free minibus will pick you up to Malaga train station.
Collection at the Cruise Terminal at Malaga Port:
After leaving the terminal just outside the exit you will find one of our representatives with a Malagacar.com sign who will identify himself as an employee of the company. As the time of leaving the cruise ship is not always the same we require clients to call us when they are about to disembark so that we can be there within half an hour.
In the event of an accident or damage to the vehicle, the customer is obliged to fill out an accident/damage report and hand it in to our office. Likewise, in the event of theft of the vehicle, the customer is obliged to report it to the police and hand in the report to our office, as well as return the vehicle key.
For each accident or damage report that Malagacar.com has to process, Malagacar.com will charge an additional €50 for the processing of the accident. If the insurance determines that the incident was not the responsibility of the Client, this amount will be refunded. If, on the other hand, the client does not report the existence of a claim (with or without fault) and the insurance company informs us of the same, the amount of the processing fee shall be 150 €.
Insurance excess and theft (only if you choose Basic Rate) and damages to tyres, rims, hubcaps, side mirrors, windows, locks and the bottom of the vehicle. An additional insurance is available to cover the aforementioned damages and theft (in the case of not taking out the insurance offered in the previous point, at the time of picking up the vehicle, Malagacar.com will charge or block the excess amount as a deposit which will be returned to the client at the end of the contract if the vehicle is returned in the same conditions. Damages to the interior of the vehicle are not covered by the insurance. Any damage caused during the rental due to misuse or improper use will be charged to the customer. Additional drivers: The cost per additional driver shall be 6 € per day per driver with a minimum of 12 € and a maximum of 72 € per driver per 28 day rental period. For rentals of 29 days or more, the price is 2.50 €/day.
Maxi Cosi seats, Baby seats and Booster seats (*find below detailed information for each seat according to the weight of the infant / child according to regulations):
*Up to age 9 months and up to 10 kg: Maxi Cosi. From 9 kg to 18 kg and from 9 months to 3 years old: Baby Seat. From 15 to 36 kg and 3 to 12 years old: Booster Seat.
In case of renting any of the child restraint devices available, the client will be responsible for their suitability, use and placement in the vehicle.
GPS. The cost for the rental of a GPS navigation system is 5 € per day with a minimum of 15 € and a maximum of 50 € per 28 day rental period. For rentals of 29 days or more, the price is 1.80 €/day. There will be required a deposit of 100 €.
Collection of vehicles between 23 h and 8 h / 11 pm and 8 am. The collection of vehicles between the mentioned hours has a surcharge of 35 €.
Damages to the interior of the car, clutch, loss of keys, refuelling the wrong fuel type.
In the event that the car receives any damage, a damage management fee of 50 € will be applied, except there has been contracted the full-risk insurance or Full Pack rate.
If the vehicle receives a fine during the rental period the lessee or main driver is held responsible. Said fines carry a cost of 40 €.
You are not allowed to leave Spain (mainland) UNDER ANY CONDITION except for travelling to Portugal or Gibraltar for a fee of 8 €/day, with a minimum of 24 € and a maximum of 90 € and up to a rental period of no more than 28 days. In the case of rentals of 29 days or more, the price will be €3/day. In the case of travel to Portugal and/or Gibraltar without prior notice, the amount corresponding to the entire rental period will be charged. Under no circumstances may you travel outside the Iberian Peninsula, the vehicle could be immobilised immediately.
The vehicle is equipped with a GPS geolocation system for security reasons and mechanical control of the vehicle, and the lessee declares that he/she is aware of and accepts its installation and use. The data thus obtained will be treated with means, criteria of conservation, communication, access rights, rectification, portability and suppression of data protection, for which the lessor is responsible.

Unilateral prolongation by the Customer shall be considered as a non-permitted use of the vehicle for the purposes of the Customer's liability for any damage to the vehicle, and shall be treated in the same way as failure to return the vehicle within the agreed period.
The return of the vehicle must take place at the branch, date and time stipulated in the Rental Agreement. The vehicle shall be returned by the Client in the same condition in which it was delivered, together with all its documents, auxiliary equipment, tyres, tools and accessories.
The Customer may not alter any technical characteristics of the vehicle, keys, equipment, tools and/or accessories of the vehicle, nor make any modification to the exterior and/or interior appearance of the vehicle. If it does so, the Client must bear all the expenses necessary to return the car to its original state, without prejudice to the damages caused to Malagacar.com derived from the reconditioning for the time that the vehicle had to be immobilised, as well as any other damages caused to Malagacar.com.
Late return/delivery of the vehicle: In the event of the customer returning the vehicle at a date, time or place other than that specified in the contract, an extra day's rental will be charged at the current daily rate for each day or portion of a day's delay in the delivery of the vehicle. A grace period of 120 minutes is granted for the delivery of the vehicle from the scheduled time. A penalty of an additional 20% of the daily contract price for each day of delay is also established as compensation.
If the Client returns or abandons the vehicle in a place other than that indicated in the Contract, Malagacar.com may also demand the costs incurred for transfers, towing, tolls, storage and custody.
In the event that Malagacar.com is delayed in the delivery of the vehicle for more than 120 minutes from the signing of the rental contract, the client will be compensated for an extra day at the current daily rate for each day or portion of a day of delay in the delivery of the vehicle. Likewise, a penalty is established as compensation of 35 € for each day of delay.
The purpose of the vehicle return system is to check that the vehicle is returned in the manner initially agreed. To this end, staff from the leasing company will carry out a management control in which two factors will be checked: the condition of the car in relation to any possible damage it may have suffered during the rental period, the fuel level and the mileage.
A. Condition of the vehicle
The vehicle must be returned by the customer in the same state of preservation in which it was delivered. Our staff will inspect the condition of the vehicle and note any new damage. If the vehicle is not returned in the same state of repair, the Customer shall also be liable to pay compensation for the vehicle being out of service as a result of the damage suffered; we refer to the section ‘return of the vehicle’.
B. Fuel
The vehicle must be returned with the same amount of fuel as when it was collected. If the vehicle is returned with a lower amount of fuel, the amount corresponding to the missing fuel will be charged at that time.
C. Mileage
If you plan to do a lot of kilometres, please note that you will have to return to the local office and change the car before you have done 2500kms. In case the rental contract is for a duration of more than 28 days, the daily average of 90 kms per day cannot be exceeded. If you do not return the car before the limit specified in this point, a penalty of 2€ per kilometre will be applied.
Malagacar.com offers a new system of roadside assistance during your rental. This service will be operational from 8 am to 0:00 am. Just click on this link to send us your location. The customer service department will receive your message instantly and we will contact you to confirm the service and / or receipt of assistance requested. In case of service overload, if you do not receive an answer after a few minutes, you can always call us at +34 952 17 60 30.
The accepted means of payment are Visa or MasterCard credit cards.
Maestro and Electron debit cards, Diners Club and Postepay cards are not accepted, nor are prepaid cards or virtual cards.
The holder of the credit card used to pay the rent must be the holder of the contract and must be present at the time of payment.
Only one bank card can be used per contract and it has to be nominative.
The cardholder, who will be the same as the contract holder, will be responsible for the payment of any extras caused by the additional drivers of the contract.
The payer will be responsible for knowing the PIN of his bank card if paying with a card that includes this technology.
The payer must ensure that his bank card has sufficient funds at the time of collection of the vehicle in order to be able to collect the rental with all the contracted options and, in addition, if applicable, to block the amount of the pre-authorisation corresponding to the group of the rented vehicle.
In the case of special and high-end vehicles, two credit cards will be requested as a guarantee for the rental.
At the time of collection of the vehicle and payment of the rental, the rental company will charge the bank card of the contract holder for the rental charges to be paid at the counter.
The driver must hold a valid driving licence approved for driving in Spain with a minimum age indicated according to the category of vehicle rented.
Drivers over 75 years of age must take out additional insurance for €4 per day (minimum €12 and maximum €48 per contract).

In the event that the client does not arrive by flight, train or any other means that can demonstrate the tourist purpose or we have doubts that he/she has not really arrived in the manner indicated at the time of collection of the vehicle, proof confirming his/her current residence address, such as a rental contract, electricity, gas or water bill less than 2 months old, will be required. You must also provide the full address to where you are going with the rental vehicle. If you do not bring any of these documents that can prove your residence, the reservation will be null and void.
When picking up the vehicle it is essential to present your passport or ID card, driving licence and a valid credit/debit card.
We do not guarantee make, model, colour or engine when booking your vehicle, we work by category.
Our vehicles cannot be taken outside the Iberian Peninsula.
The rental company reserves the right not to rent the vehicle in case of justified doubts about the financial capacity of the customer and/or in case of a history of non-payment or incidents on the part of the customer.

In the event that a rental contract needs to be extended, the economic conditions may vary. Extensions must always be made by email, by contacting our reservations office.
The rental company is not responsible for stolen, forgotten or lost objects inside the vehicle or on our premises.
The rental of a car is not necessarily linked to a specific vehicle but to a group of similar vehicles, as far as technical and habitability characteristics are concerned.
The Customer acknowledges that he receives the vehicle described in the Contract, clean and in the specified conditions of maintenance and operation, damage, condition of the fuel tank and auxiliary equipment, which if not referred to shall be deemed to be fit for use.
The duration of the Rental Agreement shall be as stated on the front of the Rental Agreement, specifying the date and time of delivery and return of the vehicle.
Rental day refers to a period of 24 hours from the rental start time, with a courtesy period of 120 minutes for the return of the vehicle.
The maximum duration of the rental contract will be 84 days and can never be longer than this.
If the Client decides to terminate the rental before the date indicated in the Contract, Malagacar.com reserves the right not to reimburse for the early return.
Likewise, in the event that Malagacar.com unilaterally terminates the rental prior to the date indicated in the contract for reasons not attributable to the lessee and formally requires the hirer to return the vehicle, the client will be entitled to receive double the amount paid for the days of non-use of the vehicle as compensation.
The Customer undertakes to keep the vehicle in good condition and in particular, without prejudice to the obligations that may appear in other clauses of this Contract, to:
To use and drive the vehicle diligently, respecting the Law on Traffic, Circulation of Motor Vehicles and Road Safety and other applicable provisions. Any negligence for not respecting the rules will mean that the insurance coverage contracted for damages to the rented vehicle will not be applicable.
Without limiting the generality of the provisions of the preceding paragraph, he undertakes not to drive the vehicle under the influence of alcoholic beverages, narcotics, psychotropic drugs, stimulants or similar substances or in a state of reduced driving ability, such as fatigue or illness, nor to allow anyone in such circumstances to drive the vehicle.
Not to use the vehicle for illegal purposes.
Not to allow the vehicle to be driven by any person other than the customer himself or the additional drivers specified on the front of the Contract.
Not carry more passengers than specified by the vehicle manufacturer or permitted by law, or transport animals.
Not use the vehicle to move, push or tow other vehicles, trailers or objects.
Not to drive on roads or other places which, due to their poor condition, may cause damage to the vehicle.
Not to participate with the vehicle in competitions, contests, training or endurance tests of materials, accessories or products for automobiles.
Do not use petrol or fuel of a quality or characteristics other than those indicated by the manufacturer of each type of vehicle.
Keep the vehicle properly parked and locked when not in use.
Not to use the vehicle to load or transport goods of any kind, nor to mount a roof rack or load of any kind on the roof without authorisation.
Not to tamper with the vehicle's odometer in any way.
Not to use the vehicle for public passenger transport, driving courses, courier services, delivery of goods, commercial or industrial activities, or any other activity involving subletting of the vehicle.
Not to move the vehicle outside the Iberian Peninsula unless prior written authorisation has been obtained from Malagacar.com.
The Client must be in possession of a valid and approved driving license in Spain and with the minimum age in the section ‘AGE OF DRIVERS’, being the Client directly responsible for these facts, holding Malagacar.com harmless under any circumstances.
The improper use of the vehicle will make the Client directly responsible for any damage caused to the vehicle or to third parties.
Any case that breaches the provisions of this contract will be understood as an improper use in which case the Client will be liable for all damages caused to the vehicle, as well as other damages caused to Malagacar.com.
The Client and any authorised driver participate as insured parties in an Automobile Insurance Policy, a copy of which is available at the Malagacar.com office where the vehicle rental is contracted. This policy includes Civil Liability for damages to third parties derived from the use and circulation of the vehicle.
Damage to the vehicle itself in the event of collision, theft, accidental fire or vandalism will also be covered provided that the following conditions are met:
The insurance shall cover damage to wheels, windows, underbody, battery, towing service and loss of key. These coverages and guarantees shall only be valid if the Client complies with the conditions set out above for damage to the vehicle itself.
The Customer undertakes to immediately inform the leasing company of any loss or damage caused to the rented vehicle and to immediately forward to the leasing company any letters, summons or notifications relating to such loss and to provide full cooperation to the leasing company and the insurance company in the investigation and defence of any claims and proceedings. It shall be compulsory for the Client to submit, within 24 hours of the event, a duly drawn up accident or damage report. In particular, in the event of an accident, the Client shall take the following measures:
In the event of fire, vandalism, theft or disappearance of the vehicle, the Customer undertakes to notify the rental company immediately and to file a report with the police.
The Client must inform the rental company of the need to use a mandatory restraint device approved for children under three years of age or older children under 150 centimetres in height, upon payment of the corresponding rental fee, and without anchoring it in the vehicle. The Customer is in any case responsible for the installation of the device. In any case, the leasing company shall be released from any possible liability arising from personal injury or material damage resulting from the Customer's failure to use the mandatory restraint device, or its installation, or incorrect use by the Customer and from any possible manufacturing defect of the aforementioned device.
This contract shall be governed by and construed in accordance with Spanish law. The rental company declares its intention to resolve any differences amicably. If this is not possible, any dispute arising between the rental company and the Client shall be subject to the jurisdiction of the place where the rental has commenced.
